I agree to appear in "The 100TH, Seeds of Aloha" Documentary project (the “Project”) and in consideration of my appearance in the Project, and without any further consideration from ID8 (the “Producer”), I hereby grant permission for Producer to utilize my/a legally represented personʻs appearance in any and all manner and media and all rights of every kind and character whatsoever in perpetuity in and to my performance, appearance, name and/or voice and the results and proceeds thereof (the “Performance”) in connection with the Project.
Use of Content. I hereby authorize Producer, it’s agents and assignees to: photograph and record (on film, digital, video, tape, audio or otherwise) the Performance; to edit the same at its sole discretion and to include it with the performance of others and with sound effects, special effects and music; to incorporate same into the Project; and to use and to license worldwide in any manner or media whatsoever existing or yet to be invented, including without limitation unrestricted use of my/a legally represented personʻs Performance, name, likeness, voice, biographic or other information concerning me/a legally represented person in connection with the Project including but not limited to publicity and promotional, advertising and/or sales purposes. I acknowledge that the Producer owns all rights to the Performance, results and proceeds of my/a legally represented personʻs Performance and any services rendered in connection herewith.
Assumption of Risk. I understand and acknowledge the dangers and risks involved in participating in the Project including illness, personal or bodily injury, death, economic and property damage, severe emotional loss, and other losses, damages, or injuries (collectively the “Injuries/Damages”). These Injuries/Damages may be caused by actions or inactions of myself/a legally represented person or others participating in the Project and/or the conditions where the Project occurs. I acknowledge that there may be other Injuries/Damages not known to me/a legally represented person or not readily foreseeable at this time. I/a legally represented person fully accept and assume all risks of the Injuries/Damages resulting from my/a legally represented personʻs participation in the Project. I/a legally represented person expressly release, discharge and hold harmless Producer, its agents, employees, licensees and assignees from and against any and all claims which I/a legally represented person have or may have for invasion of privacy, defamation or any other cause of action arising out of production, distribution, broadcast or exhibition of the Project.
Waiver & Release. I/a legally represented person waive, release, and discharge the Producer, and its past, present and future Board, officers, employees, agents, and assigns from any and all claims, demands, actions, judgments, injunctions, orders, directives, penalties, assessments, liens, liabilities, losses, damages, costs, and expenses (including attorneys’ fees), arising or resulting from or caused by my/a legally represented person making and/or confirming any representations and/or any misstatement or inaccuracy relating thereto and/or causes of action for any Injuries/Damages, known or unknown, related to, arising from, or traceable either directly or indirectly to my/a legally represented personʻs participation in the Project and/or the use of my/a legally represented personʻs Performance.
I have read this agreement and I understand that I am giving up substantial rights, including the right to sue. I hereby represent that I/a legally represented person am/are participating in the Project freely and voluntarily. I/a legally represented person agree that the laws of the State of Hawaiʻi shall apply to this agreement and if any portion of this agreement is invalid, the remainder of the agreement shall continue in full force and effect.
IF TALENT IS UNDER 18 OR LEGALLY REPRESENTED:
By signing below, I represent that I am a parent, guardian or legal representative of the subject minor or person in the appearance release and I hereby agree that we shall both be bound thereby.
